China Product Compliance: A Buyer’s Research Checklist

Products made in China are not governed by one universal “export certificate.” Compliance depends on the product, materials, users, claims, destination country, distribution channel, and current law. The overseas buyer or importer may carry duties that cannot be delegated simply by asking a factory for a certificate.

This checklist is a research workflow. It helps organize questions and evidence, but it is not a determination that a product is legally compliant.

1. Define the exact product and intended market

Write a classification description that covers:

  • function and intended use;
  • intended and foreseeable users, including children;
  • energy source, radio function, batteries, chemicals, food contact, skin contact, or protective claims;
  • materials and critical components;
  • product variants and accessories;
  • country or economic area of sale;
  • online and physical distribution channels;
  • instructions, marketing claims, and packaging claims.

Small changes can alter the applicable rules. A product marketed to children, sold with a lithium battery, connected by Bluetooth, or described as protective may need a different research path.

Map the manufacturer, brand owner, exporter, importer of record, authorized representative if applicable, distributor, marketplace seller, and fulfillment provider.

For the European Union, official Your Europe product-compliance guidance explains that manufacturers, importers, and distributors have roles such as conformity assessment, technical documentation, traceability, and checking labels or instructions depending on the legislation.

In the United States, obligations vary by agency and product. The U.S. Consumer Product Safety Commission (CPSC) explains testing and certification for general-use products subject to CPSC-enforced rules. Since July 8, 2026, CPSC eFiling requirements apply to imported general consumer products within the described scope, with specific certificate data filed electronically at import.

Do not assume your factory becomes the destination-market importer or takes over your statutory duties because it offered “DDP shipping.”

3. Build an authoritative requirements register

Use regulator and legislation sources, not marketplace listings or supplier brochures, to identify:

  • product-specific safety rules;
  • restricted substances and material requirements;
  • electrical, radio, energy, environmental, or chemical rules;
  • labeling, warnings, instructions, and language;
  • registration, responsible-person, or economic-operator requirements;
  • test, certification, declaration, and technical-file requirements;
  • customs data and admissibility requirements;
  • post-market recordkeeping, incident, and recall duties.

Record the source URL, jurisdiction, product scope, effective date, responsible party, evidence required, and internal owner. Check planned future effective dates as well as current rules.

For U.S. textile products, for example, the Federal Trade Commission provides official Textile and Wool Acts labeling guidance. That is separate from flammability, customs, or other product-specific duties.

4. Translate rules into product specifications

A legal citation alone cannot control factory production. Convert the research into measurable requirements for:

  • approved materials and components;
  • prohibited substitutions;
  • construction and performance limits;
  • test methods and sample configuration;
  • product, packaging, and shipping labels;
  • warnings and instruction content;
  • traceability codes;
  • document retention;
  • change notification and approval.

Put these requirements in drawings, bills of materials, packaging files, and inspection checklists. Identify which characteristics are controlled by supplier declarations, incoming checks, production records, laboratory testing, or final inspection.

5. Evaluate supplier evidence by scope

When a supplier sends a report or certificate, verify:

  • supplier and manufacturer identity;
  • tested model and variant;
  • photographs and bill of materials;
  • standard or regulation and edition;
  • test methods and results, not only the cover page;
  • issue date and any validity limitations;
  • laboratory identity and accreditation scope where relevant;
  • report authenticity with the issuer;
  • whether later design, material, component, or factory changes occurred.

A genuine report for a different model is not evidence for your product. A passed chemical test on one color may not cover every pigment or material. A management-system certificate is not a product-compliance certificate.

6. Create a risk-based test plan

Use a qualified laboratory or compliance specialist to determine the correct samples, standards, and test sequence where rules require expertise.

Plan early enough that failures can be corrected before production. Testing only a finished production lot can produce expensive scrap, delay, or relabeling.

Control sample selection. Record who selected the unit, from which material or production lot, and whether it represents the intended bill of materials. For safety-critical programs, independently selected samples may be appropriate.

7. Review labels and claims separately

Product, package, instructions, online listing, and advertising should be checked as one claim system. Verify:

  • responsible company identity and contact details where required;
  • model, batch, serial, or other traceability;
  • country of origin;
  • required conformity or disposal marks;
  • warnings, age grading, and user instructions;
  • fiber, material, capacity, performance, or environmental claims;
  • required language and legibility;
  • consistency between tested product and marketed claim.

A compliant product can still create enforcement risk through an unsupported claim or missing online information.

8. Control production and changes

Compliance testing describes the tested configuration. Ongoing conformity requires control of mass production.

Specify that changes to critical material, component, design, firmware, tooling, factory, subcontractor, process, label, or packaging require written review before implementation. Maintain an approved bill of materials and revision record.

Use incoming inspection, supplier declarations, periodic testing, process controls, and pre-shipment inspection according to risk. The CPSC publishes manufacturing best practices that emphasize a product-safety process rather than relying on end-product testing alone.

9. Prepare the import and technical file

The required file varies, but may include:

  • product and company identification;
  • regulatory research register;
  • risk assessment;
  • drawings and bill of materials;
  • standards list;
  • laboratory reports and certificates;
  • declarations of conformity or compliance;
  • labels, warnings, and instructions;
  • supplier and production records;
  • inspection and traceability records;
  • customs classification and import data;
  • change approvals and corrective actions.

Make sure records remain accessible for the legally required period and to the party that must produce them.

10. Plan post-market response

Define how complaints, incidents, returns, and regulator requests will be recorded and escalated. Maintain distribution and lot records sufficient to identify affected product. Agree with suppliers how investigation, containment, replacement, reporting, and recall costs will be handled, while recognizing that contracts do not erase statutory responsibilities.

Research checklist

  • Product and intended user are clearly defined.
  • Destination markets and sales channels are listed.
  • Each economic operator and importer role is assigned.
  • Requirements come from current authoritative sources.
  • Rules are translated into controlled specifications.
  • Evidence matches the exact product and production configuration.
  • Test and labeling plans are approved before mass production.
  • Changes require review and written authorization.
  • Import and technical records are complete and retrievable.
  • Complaint, incident, and recall processes are defined.

Compliance is not a folder of supplier PDFs. It is a documented chain from product definition and legal research through design, testing, manufacturing, import, sale, and post-market monitoring.
